Utility Litigation Monthly Watchdog Report

eComp Consultants influential in settlement of Ameranth v. Six Continents Hotels web advertising misuse and trade secret litigation

eComp consultants Virginia Lee, Jan Kostyun, and Ivan Zatkovich were retained by Alston & Bird as consulting and testifying experts on behalf of Six Continents Hotels. Ameranth, a software development firm, claimed Six Continents Hotels misused their trade secrets and limited web-based advertising opportunities. Ameranth was expecting huge revenues based on advertising they felt the Six Continents brand could garnish and therefore were seeking large damage dollars.

eComp Consultants provided a strong background on standard advertising practices, actual market characteristics and realistic revenue expectations. eComp Consultants also supplied the defendant, Six Continents Hotels, with a trade secret analysis based on the Whelan Test (from Whelan v Jaslow) and Abstraction, Filtration, Comparison Test (aka Altai test, from Computer Associates v Altai) methodologies used in many cases of this type. Alson & Bird used this information to supplement their arguments in mediation and were pleased with the speedy resolution.
